By accessing and using Stay Formosa's vacation rental platform, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using our services.

2. Description of Service

Stay Formosa provides a platform for booking vacation rental properties in Orlando, Florida, near Walt Disney World and Universal Studios. Our services include:

• Property listings and availability search
• Online booking and payment processing
• Guest support and property management
• Communication between guests and property owners
• Booking modifications and cancellation processing

3. User Accounts and Registration

Account Creation

To book properties, you must create an account and provide accurate, complete information. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized use
• Ensuring your contact information remains current

4. Booking Terms and Conditions

Booking Process

• All bookings are subject to availability and confirmation
• Prices include base rate, cleaning fees, and applicable taxes
• Security deposits may be required for certain properties
• Minimum stay requirements apply during peak seasons
• Check-in is typically 4:00 PM, check-out is 11:00 AM

Payment Terms

• Payment is due at time of booking confirmation
• We accept credit cards, PayPal, and Zelle payments
• For alternative payments (Zelle/PayPal), payment must be completed within 24 hours
• Failure to complete payment will result in booking cancellation
• All payments are processed securely through encrypted systems

5. Guest Responsibilities

As a guest, you agree to:

• Provide accurate information about your party size and composition
• Comply with property-specific house rules and occupancy limits
• Treat the property and furnishings with care and respect
• Report any damages or issues immediately
• Not engage in illegal activities or disturb neighbors
• Not sublease or transfer your booking to others
• Leave the property in good condition upon departure

6. Cancellation and Modification Policy

Our cancellation policy varies based on timing and property type. Standard policy:

• More than 30 days before check-in: Full refund minus processing fees
• 8-30 days before check-in: 50% refund
• 7 days or less before check-in: No refund
• 72 hours or less: No refund, no exceptions

Modifications to existing bookings are subject to availability and may incur additional charges. All cancellation and modification requests must be submitted through our platform.

7. Property Standards and Maintenance

Stay Formosa strives to maintain high standards for all properties. However, we do not guarantee that properties will be free from minor maintenance issues or normal wear and tear. We will address any significant issues promptly upon notification.

8. Limitation of Liability

Stay Formosa's liability is limited to the amount paid for your booking. We are not liable for indirect, incidental, or consequential damages, including but not limited to lost profits, travel expenses, or personal injury not directly caused by our negligence.

9. Force Majeure

We are not liable for any failure to perform due to circumstances beyond our reasonable control, including natural disasters, government actions, pandemics, or other force majeure events. In such cases, we will work with guests to find reasonable solutions.

10. Privacy and Data Protection

Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your personal information. By using our services, you consent to our data practices as described in our Privacy Policy.

11. Intellectual Property

All content on our platform, including text, graphics, logos, and software, is owned by Stay Formosa or our licensors and is protected by copyright and trademark laws. You may not reproduce, distribute, or create derivative works without our written permission.

12. Dispute Resolution

Any disputes arising from these terms or your use of our services will be resolved through binding arbitration in Orange County, Florida, under the rules of the American Arbitration Association. You waive any right to participate in class action lawsuits.

13. Governing Law

These Terms of Service are governed by the laws of the State of Florida, without regard to conflict of law principles. Any legal action must be brought in the courts of Orange County, Florida.

14. Changes to Terms

We reserve the right to modify these terms at any time. We will notify users of significant changes via email or platform notifications. Continued use of our services after changes constitutes acceptance of the new terms.

15. Termination

We may terminate or suspend your account immediately for violations of these terms, fraudulent activity, or other conduct that we deem harmful to our platform or other users.
